Agreement to our legal terms

We are KuraBooth ("Company", "we", "us", or "our"). We operate KuraBooth, a photo booth web application for events, as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and KuraBooth concerning your access to and use of the Services. By accessing the Services, you agree that you have read, understood, and agreed to be bound by these Legal Terms. If you do not agree with all of these Legal Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

Supplemental terms and documents that may be posted on the Services from time to time are expressly incorporated by reference. We reserve the right to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about changes by updating the "Last updated" date above. Your continued use of the Services after revised Legal Terms are posted means you accept the revised Legal Terms.

1. Our Services

The Services provide a web-based photo booth experience for events. Hosts can create an event booth, configure event settings, share a booth link or QR code with guests, collect guest photo reels, manage event usage, and, where available, purchase or order related products such as print items.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation, or which would subject us to any registration requirement. Those who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

2. Intellectual Property Rights

Our intellectual property

We are the owner or licensee of intellectual property rights in the Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content"), as well as trademarks, service marks, and logos (the "Marks").

The Content and Marks are provided in or through the Services "as is" for your personal, non-commercial use or internal business purpose only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and download or print a copy of Content to which you have properly gained access, solely for your personal, non-commercial use or internal business purpose.

Except as set out in these Legal Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for a commercial purpose without our express written permission. We reserve all rights not expressly granted. Any breach of these intellectual property rights is a material breach of these Legal Terms and your right to use the Services will terminate immediately.

Your submissions

By directly sending us questions, comments, suggestions, ideas, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in those Submissions. We may use and share Submissions for any lawful purpose, commercial or otherwise, without acknowledgement or compensation to you.

You are responsible for what you submit. You confirm that your Submissions do not breach the prohibited activities below, that you have the rights needed to submit them, that you waive moral rights to the extent permitted by law, and that your Submissions do not constitute confidential information.

3. User Representations

By using the Services, you represent and warrant that:

• You have legal capacity and agree to comply with these Legal Terms.
• You are not a minor in the jurisdiction in which you reside.
• You will not access the Services through automated or non-human means.
• You will not use the Services for an illegal or unauthorised purpose.
• Your use of the Services will not violate applicable law or regulation.

If information you provide is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse current or future use of the Services.

4. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to:

• Systematically retrieve data or content to create a collection or database without our permission.
• Trick, defraud, or mislead us or other users.
• Circumvent or interfere with security-related features of the Services.
• Use information obtained from the Services to harass, abuse, or harm another person.
• Make improper use of support services or submit false reports.
• Use the Services in a way inconsistent with applicable laws or regulations.
• Upload or transmit viruses, Trojan horses, or other disruptive material.
• Use scripts, robots, data mining tools, or similar automated extraction tools.
• Attempt to impersonate another user or person.
• Interfere with, disrupt, or create an undue burden on the Services.
• Attempt to bypass access restrictions or protective measures.
• Copy, adapt, decipher, decompile, disassemble, or reverse engineer the Services' software except as permitted by law.
• Make unauthorised use of the Services, including collecting user email addresses or creating accounts by automated means or under false pretences.
• Use the Services to compete with us or for an unauthorised revenue-generating enterprise.

5. User Generated Contributions

Users may create, submit, upload, display, transmit, or otherwise make available photos, photo reels, event settings, messages, comments, suggestions, or other materials through or in connection with the Services ("Contributions").

When you create or make Contributions available, you represent and warrant that they comply with these Legal Terms, that you have the necessary rights to make them available, and that they do not violate the privacy, publicity, intellectual property, contractual, or other rights of any third party.

6. Contribution License

You and KuraBooth agree that we may access, store, process, and use information and personal data that you provide, including settings and choices, to provide and operate the Services.

By submitting suggestions or feedback regarding the Services, you agree that we can use and share that feedback for any purpose without compensation to you.

We do not assert ownership over your Contributions. You retain ownership of your Contributions and associated intellectual property rights. You are solely responsible for your Contributions and agree to release us from responsibility for them, except as required by applicable law.

7. Services Management

We reserve the right, but not the obligation, to monitor the Services for violations of these Legal Terms, take appropriate legal action, report users to law enforcement, refuse or restrict access to Contributions, remove or disable files and content that are excessive or burdensome, and otherwise manage the Services to protect our rights and facilitate proper operation.

8. Term and Termination

These Legal Terms remain in effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services, terminate your use of the Services, or delete your account and content at any time, including for breach of these Legal Terms or applicable law.

If your account is terminated or suspended, you are prohibited from registering a new account under your name, a fake or borrowed name, or the name of a third party, even if acting on behalf of that third party. We may also pursue civil, criminal, or injunctive relief.

9. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason without notice. We will not be liable for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems, or perform maintenance, resulting in interruptions, delays, or errors. Nothing in these Legal Terms obligates us to maintain and support the Services or supply corrections, updates, or releases.

10. Governing Law

These Legal Terms are governed by and interpreted in accordance with the laws of England and Wales. You and we irrevocably agree that the courts of England and Wales will have exclusive jurisdiction to resolve disputes arising in connection with these Legal Terms, subject to any mandatory legal rights that apply to you as a consumer.

11. Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms, you and we agree to first attempt to negotiate the dispute informally by written notice before starting court proceedings, except where urgent injunctive or protective relief is required.

Disputes seeking to enforce or protect intellectual property rights, disputes related to theft, piracy, invasion of privacy, unauthorised use, or claims for injunctive relief may be brought without prior informal negotiation.

12. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

13. Disclaimer

The Services are provided on an as-is and as-available basis. Your use of the Services is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services and your use of them, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties about the accuracy or completeness of the Services' content or linked content, and assume no liability for errors, personal injury or property damage, unauthorised access to secure servers, interruption or cessation of transmission, bugs or viruses transmitted by third parties, or loss or damage incurred from content made available through the Services.

We do not warrant, endorse, guarantee, or assume responsibility for products or services advertised or offered by third parties through the Services or linked websites.

14. Limitations of Liability

To the fullest extent permitted by law, we and our directors, employees, and agents will not be liable to you or any third party for direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

Notwithstanding anything to the contrary, our liability to you for any cause and regardless of the form of action will be limited to the amount paid by you to us for the event or product giving rise to the claim, unless applicable law requires otherwise.

15. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable legal fees and expenses, made by any third party due to or arising out of your use of the Services, breach of these Legal Terms, breach of your representations and warranties, violation of third-party rights, or harmful act toward another user.

We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.

16. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular backups, you are responsible for data you transmit or activity you undertake using the Services.

You agree that, to the extent permitted by law, we have no liability for loss or corruption of such data, and you waive any right of action arising from such loss or corruption.

17. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and agree that agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

You agree to the use of electronic signatures, contracts, orders, and records, and to electronic delivery of notices, policies, and transaction records initiated or completed by us or via the Services.

18. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision does not operate as a waiver.

These Legal Terms operate to the fullest extent permitted by law. We may assign our rights and obligations to others at any time. We are not responsible for loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.

If any provision is unlawful, void, or unenforceable, that provision is severable and does not affect remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us by these Legal Terms or your use of the Services.
